เมื่อความถูกต้องทางกฎหมาย อยู่เหนือความถูกต้องทางศีลธรรม (ฉบับปรับปรุง)
เวอร์ชั่นใหม่ของบทความที่โพสต์เมื่อวันที่ 3 กุมภาพันธ์ 2549 ที่ผ่านมา ผู้เขียนฝากบอกมาว่า:

great article krub. Yet there are some mistake and half truths in there a krub. ex: Thaksin’s famous quote one non patriotic act. Please read+include the full quote or it’ll create some misunderstanding.
About telecom-porrorbor please read precisely what it said ie. what kind of telecom company cannot have more than 49% of share holder.
and many more. Please revise and make it a perfect non-bias piece of reading.

Khun Tee: Thank you for the comments ka. However, I don’t think there’s any “half-truth” in the article - with the exception of the full quote regarding patriotic act; I will try to find fuller quotes on that. The 49% foreign shareholding requirement in telecom por ror bor, for example, isn’t contradicted in the piece at all - the article simply focuses on how Temasek could achieve control of SHIN companies while complying with 49% shareholding requirement. If you think there is really any “half-truth” or outright factual mistakes, please do let me know specifically which one(s) so I can either clarify it here, or tell the authors to edit the article if it turns out to be really wrong.

From searching the Thai government’s web (www.thaigov.go.th/news/speech/thaksin/sp20may45.htm):
His comment that “เห็นมั้ยครับว่าอเมริกากำลังจะแย่เพราะมีบริษัทอเมริกาเลี่ยงไปตั้งสำนักงานใหญ่” seems clear to me that he wants to blame Thai companies who register on BVI as “non-patriotic” too, even though he didn’t specifically say it.
“ผมเห็นตัววิ่งใน CNN ปรากฏว่าสภาของหสรัฐอเมริกากำลังพิจารณาแก้กฎหมาย ที่มองว่าบริษัทอเมริกาที่เอา head quarter ไปตั้งที่ ประเทศที่เป็นสวรรค์ด้านภาษี (tax heaven country) บอกว่าเป็นพวกไม่รักชาติ ( non-patriotic ) เห็นมั้ยครับว่าอเมริกากำลังจะแย่เพราะมีบริษัทอเมริกาเลี่ยงไปตั้งสำนักงานใหญ่ ( head quarter ) ทางทะเบียน ทางกฎหมาย ที่ปานามา ที่ British Virgin Island บ้าง ส่วนสำนักงานใหญ่ ( Head Quarter ) จริงๆ ตั้งอยู่ที่อเมริกาเพื่อเลี่ยงภาษี อเมริกาเรียกพฤติกรรมเช่นนั้นว่า non-patriotic เขาจึงแก้กฎหมาย”
So the “correct” version is that USA is the one who said BVI-registered companies are “non-patriotic,” not Thaksin. But this ‘mistake’ seems rather trivial to me, because it still keeps the gist of the quote intact. This actually makes the situation even worse for Thaksin because it means EVEN the USA government, the world’s #1 superpower, is calling BVI companies unpatriotic. Therefore, it would be very unlikely to think that somehow Thaksin, head of a much smaller country than USA, would want to suggest otherwise
